Terms of Service

These terms govern your use of Spotter, an iOS app that coaches you through gym workouts via your AirPods. By installing or using the app, you agree to these terms. If you don't agree, please don't use the app.

1. Eligibility

You must be at least 13 years old (or the minimum age in your country to consent to processing of personal data without a parent's permission) to use Spotter. If you are under 18, you should review these terms with a parent or guardian.

2. The service

Spotter generates workout plans using a large language model (Anthropic's Claude) and coaches you through them in real time via spoken cues through your AirPods. It is a software product. It is not a personal trainer, a doctor, a physiotherapist, or a substitute for any of those.

3. Not medical advice — important

This bears repeating from the in-app disclaimer: Spotter does not provide medical, healthcare, or therapeutic advice. Workout plans, weight prescriptions, exercise selections, and motivational cues are suggestions generated by software, not personalized professional advice.

You agree to use Spotter at your own risk. We are not liable for injuries, health problems, or consequences arising from your use of the app, to the maximum extent permitted by applicable law.

4. Subscription terms

Spotter offers a free tier (3 generated workouts per ISO calendar week, plus the built-in Apple voices) and a paid subscription called Spotter Premium:

Premium unlocks unlimited generated workouts and access to the realistic ElevenLabs-powered trainer voices.

4.1 Billing & renewal

All subscription billing is processed by Apple via your App Store account. Subscriptions auto-renew at the end of each billing period unless you cancel at least 24 hours before the period ends. The renewal price is the same as the original purchase, unless we notify you of a change as required by Apple's terms.

4.2 Free trials

If your subscription includes a free trial, you can cancel any time before the trial ends to avoid being charged. If you don't cancel, your card will be charged at the end of the trial period.

4.3 Cancellation

To cancel, open Settings → [Your Name] → Subscriptions on your iPhone, or open the App Store app, tap your profile, then Subscriptions. Cancellations take effect at the end of the current billing period — you keep premium access until then.

4.4 Refunds

All refunds are handled by Apple under their standard refund policy. We do not process refunds directly. To request a refund, see support.apple.com/en-us/HT204084.

4.5 Price changes

If we change subscription prices, Apple will notify you in advance and (where required) ask you to confirm the new price before the next renewal. You can cancel before the change takes effect to avoid being charged the new price.

We may suspend or revoke access (including premium entitlements) for accounts or devices that materially breach these terms. We will refund any unused subscription period via Apple if we revoke premium for a reason other than a material breach by you.

6. Intellectual property

Spotter's source code, design, brand, and the trainer's coaching voice are owned by Haroto. Generated workout plans and trainer cues for your specific session are yours to use as you see fit; we don't claim any rights over the recommendations the AI generates for you. Profile data and workouts you create remain yours.

7. Disclaimers

Spotter is provided "as is" and "as available", without warranties of any kind, express or implied, except as required by applicable consumer law. We do not warrant that the service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not warrant that the trainer's recommendations will achieve any particular fitness, body-composition, or health outcome.

8. Limitation of liability

To the maximum extent permitted by applicable law, our total liability for any claim arising from your use of Spotter is limited to the amount you paid for the subscription in the 12 months preceding the claim, or €50, whichever is greater. We are not liable for indirect, incidental, special, or consequential damages, including lost profits, lost data, or loss of goodwill.

Nothing in these terms limits liability that cannot be limited by law (for example, liability for gross negligence, intent, or for personal injury caused by our negligence in jurisdictions where such limitation is prohibited).

9. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your breach of these terms or your misuse of the app — provided we promptly notify you of the claim and you have sole control over its defence and settlement.

10. Termination

You can terminate your relationship with us at any time by uninstalling the app and cancelling any active subscription via the App Store. We can terminate or suspend your access at any time for material breach of these terms; we'll usually give notice unless doing so would compromise security or expose us to legal risk.

11. Governing law & jurisdiction

These terms are governed by the laws of Greece, without regard to conflict-of-law principles. Disputes are subject to the exclusive jurisdiction of the courts of Athens, Greece, except where local consumer law gives you the right to bring a claim in your home jurisdiction.

12. Changes

We may update these terms from time to time. If changes are material, we'll notify you in the app or by email (if you've given us one). Continued use after the effective date of the updated terms constitutes acceptance.
